A guest is a customer who lawfully utilizes a facility's food, beverage, lodging or entertainment services. A hospitality manager's goal is to develop and retain a viable guest base. Success and profitability in the hospitality industry is impossible without a sufficient number of guests. Guests come with guest related challenges, particularly when the legal implications are considered.
If a guest has her purse stolen at a restaurant in the hotel is the hotel or the guest responsible for the lost caused upon her? In this case it would be the guests problem because he/she still was a guest of the hotel and it's her responsibility to keep track of her purse if it has valuable items in it. If she tried to sue the hotel she would not win because she is the one liable in this situation.
There are Exceptions to absolute liability. The rule that said the hotel was liable for all guests goods had three exceptions to it. One being if there's a natural disaster such as a tornado the hotel is not in charge of the items. Loss caused by a public enemy such as a terrorist or wartime. Finally negligence of a guest by leaving luggage in the lobby. If they leave their baggage unattended to the public it is not the hotels fault that you were irresponsible with their valuables.
It is important for a hotel to practice safe procedure for their guests that check into the hotel. All state legislatures have adopted statues that limit the hotels liability for a guests lost item.Certain provisions that have been made are he hotel must provide a safe for the use of guests, must make guests aware about the safes they have provided for them, also must make a note obvious to guest that the hotel is not 100%liable for their lost items. The guests is not responsible to use it wisely.
I think that it is a good idea that hotels have gotten rid of the use of keys to enter into rooms and now have gravitated towards the use of the electronic key system. This is a better system for hotels to use because it allows the hotel to change the code that opens the door every time they have a new guest coming into the hotel. This allows more safety for the hotel and guest who stays so in the room because it guarantees no one else had a key to that room.
The liabilities of hotels and restaurants for their guests and patrons property has changed over time. The common law imposed unlimited liability on inns and food establishments. If a guest is checked into a hotel the hotel becomes liable for their goods. If any of the guests items do get stolen they may sue hotel for irresponsibly taking care of their valuables.
